Charged to 100% in about 50 or so minutes said battery was low and didn’t do to much setup an avatar and setup another profile on it does this mean I might need a new battery ?

Is this a brand new headset you've got or one you've had for a while?
I think the next best step to take would be to attempt a hard reset while the headset is charging:
- Hold down the power and volume down (-) buttons for 30 seconds
- Put on the headset
- Use the volume buttons to highlight 'Boot Device' and select it with the power button.
- Use the volume buttons to highlight 'Yes' and select it with the power button.
(If you hear the headset boot up, you don't need to do the other steps)

I will try that and unsure how old it was bought it at a store used. Can I check to see how many hours it’s been used ?

There's no way to check that, unfortunately.
Was the store able to tell you if the headset was still within warranty?

No, there's no way to do so.
