my brother recommend me to use sidequest but i find it shady i need a developer account to use it i just want to know if it could get me banned for Using it or if there is any risk at all

My brother gave me his meta quest 2 and before he gave it to me he used side quest and modded games on it he factory reseted it before he gave it to me could my account get banned because he modded games on it?

If the headset underwent a factory reset, and the Meta account(s) that potentially violated any of our terms or policies are no longer on the device, linked to the Meta account, Meta Quest Link App, Meta Quest mobile app, and Meta Quest Developer Hub, then your Meta account shouldn't be affected. My recommendation would be to make sure your headset isn't associated to his account anywhere across the Meta Quest platform.

You'd need to ask your brother where he had his headset connected to. The main affiliations are what I mentioned previously:
The most important part is just to make sure the device is no longer connected to his Meta account. Usually a factory reset will remove it, but it's always a good idea to double check. If you run into issues, I recommend PMing @MetaQuestSupport to get help.

As I mentioned, if the headset was factory reset before he gave it to you, it should be cleared from his account after you activate it again. By activate, I just mean setting up the device again using your Meta account. If you want to be extra sure about it, you can have him check his Meta account's Device settings.

No problem! The Platform Abuse Policy under the Policy Against Abuse section also goes over what we consider abuse of Developer Mode:
We consider it an abuse of Developer Mode, and a violation of our Terms of Service and Code of Conduct for Virtual Experiences, to do any of the following in connection with Developer Mode:
- Upload, distribute, or sideload any of the following:
- Content that appears to be infringing, copied, or pirated; or
- Content that contains malicious code; or mods of any app available on or through the platform, if those mods appear to infringe on any intellectual property rights, introduce malicious code, give players an unfair advantage, or are otherwise unapproved.
- Use software or other tools to extract assets or content (e.g., videos, music, etc.).
- Violate other provisions of the Meta Platforms Technologies Terms of Service or Code of Conduct for Virtual Experiences, or any other Meta Platforms Technologies terms, policies or guidelines, or otherwise misuse the platform.
