Well it seems like the AMD driver is your issue then, so why would Oculus do anything under warranty? its AMD you need to speak with, this is why Support is always bogged down and take a while to answer things, Oculus I highly doubt are withholding any information about AMD graphics etc..
I am sure in the next AMD software update it will resolve it.
I bought mine second hand and have had no issues. I bought it from a site that let me check the product for 24 hours before they sent the money to the seller. It was also unopened and unused.
