Question

Poll: Will Facebook and Oculus prevail against ZeniMax?

First off, I know several threads about this topic exist. This is not an
attempt to restart the debate. Since the verdict should be coming in
the next few hours (the jury deliberates today), I am curious to see how
this community believes the Jury will vote.

Synopsis: ZeniMax has 9 lawsuits, 5 of which are against Facebook and the rest against Oculus. Details in a discussion thread here:
https://forums.oculus.com/community/discussion/comment/488527/#Comment_488527

So with that in mind, what will the Jury decide??

Well that's good news... The trade secrets was the big claim. As far as the NDA, there could be some minor punitive damages for it, but it's not a two four six billion dollar failure. I guess we'll see what the jury comes back with.

$500,000,000 is quite the payout for breaking an NDA.  Zenimax got what they came for: an easy cash grab.

That's a pretty good payout for no significant contribution to VR. That's more than I thought they'd get if they were awarded anything--I guessed that a jury might give them the original 15% they'd asked for before the buyout, x 2 billion valuation from FB, for a potential payout of $300 million.

So those parasites got half a billion dollars out of this circus act, eh?  What a joke, but at least it's over.

Maybe now the media can go back to covering all the wonderful things Oculus is doing for this industry and the people working in it, instead of sensationalizing these petty scandals.

Here's a breakdown of the $500 million payout:

Of the $500 million, Oculus is paying out $200 million for breaking the
NDA and $50 million for copyright infringement. Oculus and Luckey each
have to pay $50 million for false designation. And Iribe has to pay $150
million for the same, final count.

Pennies on the dollar. The next Elder Scrolls better be ground breaking, and in VR.

If Zenimax ended up prevailing against Oculus only then that means my vote in this court-docket-starved polling game lost, as did that of anyone who voted that Zenimax would "lose on all counts." Based on what's been disclosed to the public so far, it seems that only four forum members chose what turned out to be the right answer.

I would have chosen "Zenimax will prevail against both Oculus and Facebook, but for much less than ZeniMax has asked" had it been one of the choices.

Zenimax reportedly submitted ~900 'sealed dockets' to which the jury had access but that were unavailable to the public, so anyone voting in this poll was clearly doing so for entertainment purposes.

I was heavily biased against Facebook but also heavily biased in favor of Oculus because they have some truly great, seemingly honest and inspiring people who don't deserve to be punished or have their dreams limited by such lawsuits.

    Statement from Oculus:

Reached for comment shortly after the verdict, Oculus
said they will be appealing, but that they look forward to eventually
    putting the case behind them.

"The heart of this case was about whether Oculus stole
ZeniMax's trade secrets, and the jury found decisively in our favor,” an
Oculus spokesperson told Polygon. “We're obviously disappointed by a
few other aspects of today's verdict, but we are undeterred. Oculus
products are built with Oculus technology. Our commitment to the
long-term success of VR remains the same, and the entire team will
continue the work they've done since day one – developing VR technology
that will transform the way people interact and communicate."

Carmack did no wrong, which I argued repeatedly in this case. Score one for innovative developers!

Yeah, I'm glad Carmack was cleared. I'm a little surprised that the biggest personal hit was taken by Iribe. Maybe the personal amounts were proportional to what they got as retention bonuses.
